1. Seller

These General Conditions of Sale govern all purchases made on garcias.it (the "Site"). The seller is GARCIA NICOLAS, trading as "GARCIAS", sole proprietorship registered in Italy, Via Lodovico Settala 4, 20124 Milan (MI), Italy, VAT number IT12718870962, certified email (PEC) garcias@pec.it ("GARCIAS").

2. Scope

These Conditions apply to sales of products to consumers and to business customers through the Site. For consumers resident in the European Union, the mandatory provisions of the Italian Consumer Code (Legislative Decree 206/2005) and of the law of their country of residence remain fully applicable. By placing an order, the customer confirms having read and accepted these Conditions, which can be saved and printed from this page.

3. Products and prices

Products are described on their product pages as accurately as possible. Colours may vary slightly depending on screen settings. Prices are shown in euro and include Italian VAT. Shipping costs are shown in the cart and at checkout before the order is confirmed. For deliveries outside the European Union, customs duties and import taxes may apply and are payable by the customer, unless otherwise stated at checkout.

4. Orders and conclusion of the contract

The contract is concluded when GARCIAS sends the order confirmation email. GARCIAS may refuse or cancel an order in case of product unavailability, evident pricing errors or suspected fraud; in that case any amount paid is refunded in full without delay.

5. Payment

Accepted methods are shown at checkout: credit and debit cards (Shopify Payments), PayPal, Klarna, Shop Pay, Google Pay and Apple Pay. Payments are processed by the respective providers; GARCIAS does not store full card details.

6. Shipping and delivery

Italy: standard €7 (2–4 business days), express €15 (1–2 business days)
European Union: standard €12 (3–6 business days), express €25 (2–3 business days)
United Kingdom, USA, Switzerland and other international destinations: standard €25 (5–10 business days)
Latin America: standard €28 (5–10 business days)

Standard shipping is free worldwide on all orders of €250 or more. Delivery times run from dispatch and are estimates. The customer receives a tracking link by email once the order has shipped. Risk of loss passes to consumers only when they, or a person they designate, take physical possession of the goods.

7. Right of withdrawal

Consumers may withdraw from the contract within 14 days of delivery without giving any reason, by writing to info@garcias.it with the order number and the items concerned. Items must then be sent back within 14 days of the withdrawal notice. For deliveries within the European Union GARCIAS provides a prepaid return label; for other destinations the direct cost of return is borne by the customer.

GARCIAS refunds all payments received, including standard delivery costs, within 14 days of receiving the withdrawal notice, using the original payment method. The refund may be withheld until the goods have been received back. The customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics; for this reason items should be returned unworn, unwashed and with original tags attached. The right of withdrawal does not apply to made-to-order or personalised items.

Exchanges for a different size can be requested at the same address within 14 days of delivery, subject to availability.

8. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity for consumers (articles 128 and following of the Italian Consumer Code) for defects that become apparent within two years of delivery. In case of a defective, damaged or incorrect item, please write to info@garcias.it with the order number and photos: GARCIAS will arrange repair, replacement or a refund as provided by law, at no cost to the customer.

9. Personal data

Personal data are processed in accordance with our Privacy Policy.

10. Applicable law and disputes

These Conditions are governed by Italian law, without prejudice to the mandatory consumer protection rules of the consumer's country of residence. For consumers, the court of the place of residence or domicile of the consumer has jurisdiction.
